Your agreement with Batchmates

WELCOME TO THE BATCHMATES COMMUNITY!

These terms help us maintain a safe, supportive environment where all students can connect, learn, and grow together.

By registering for and using this platform, you affirm and agree to the following:

Age Requirement

You are at least 15 years old as of the official date of publication of the app.

Student Status

You are a currently enrolled student at a recognized college or university and possess a valid and authentic college identification card (College ID).

College Verification

Your institution must be listed in our database. You are required to enter a valid college code at the time of registration. We reserve the right to independently verify your college enrollment and authenticity of the ID submitted.

Legal Capacity

You have the full right, power, and legal capacity to enter into and comply with these Terms and Conditions. If you are accessing the platform on behalf of an institution or other legal entity, you have full authority to bind them to these terms.

Compliance with Laws

You are not located in, under the control of, or a national or resident of any country subject to sanctions, embargoes, or similar legal restrictions. You also affirm that you are not prohibited by any applicable law, regulation, or order from using the services offered.

Truthful Representation

You agree that all information provided during registration and use of the platform is accurate, complete, and up to date. Submission of false or misleading information may result in immediate suspension or termination of your access to the platform, and may also carry legal consequences.

Right to Deny Access

We reserve the right to refuse, suspend, or revoke access to the platform to any user who, in our sole discretion, does not meet the eligibility criteria or is found to be in violation of these terms or applicable laws.

For the purposes of these Terms and Conditions, the following terms shall have the meanings ascribed to them below:

"Platform"

Refers to the mobile application, website, or any digital service operated by Batchmates, through which users can access its features, services, and content.

"User", "You", or "Your"

Means any individual who accesses or uses the Platform, including students, registered members, visitors, or any person acting on behalf of an institution.

"We", "Us", or "Our"

Refers to Batchmates, the operator and owner of the Platform, including its employees, agents, partners, and affiliates.

"Content"

Means all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials uploaded, posted, transmitted, or otherwise made available through the Platform by any user.

"Services"

Refers to all the features, functionalities, resources, and tools provided via the Platform, including but not limited to user profiles, messaging, educational tools, networking opportunities, and any paid or free offerings.

"College ID"

Means a valid identity document issued by a recognized educational institution that verifies your current enrollment status as a student.

"College Code"

Refers to a unique identifier issued or accepted by us to verify your institution's eligibility and your association with it.

"Account"

Refers to the registered user profile created by you to access and use the Platform.

"Applicable Law"

Means any statute, law, regulation, ordinance, rule, judgment, order, decree, directive, or guideline having the force of law in the jurisdiction where the Platform is accessed or used.

By using this Platform, you acknowledge that all actions you take are done voluntarily and that you are responsible for your participation. This section outlines the principles and expectations around your use:

Voluntary Use

Your use of the app is entirely voluntary. No party, including Batchmates, compels you to download, register, or engage with the Platform.

Personal Use Only

The app is provided solely for your personal, non-commercial use unless expressly authorized in writing by Batchmates.

Autonomous Participation

Any tasks, features, or interactions you engage in are done of your own free will. Your activity is not considered employment, contract work, or part of any legal obligation.

Binding Action

All actions taken via your account will be deemed as performed by you. If someone else accesses your account, you are responsible for their actions unless proven otherwise.

Account Accuracy

You are required to provide accurate, truthful, and current information at the time of registration and during all usage of the app.

Respect for Other Users

You agree to treat other users with respect and integrity, refraining from harassment, bullying, or disruptive behavior.

Platform Integrity

You shall not attempt to hack, reverse engineer, extract source code, bypass authentication systems, or tamper with any aspect of the app or its services.

No Unauthorized Automation

You may not use bots, scripts, or automated systems to access or interact with the app.

Acknowledgment of Risk

You acknowledge that by using the app, especially during beta testing or community tasks, there may be technical glitches, experimental features, or temporary disruptions for which we are not liable.

By opting in to use this Platform, you agree to the following:

  • You have voluntarily chosen to engage with the Platform and its services without any coercion.
  • You will use the Platform exclusively for the purposes it was designed for, including verified student engagement, task participation, networking, learning opportunities.
  • You agree not to use the Platform for any unauthorized, unlawful, or unintended purposes, including but not limited to commercial exploitation, harassment, or disruptive activities.
  • Your participation in specific tasks, challenges, or features within the Platform reflects your informed consent and voluntary acceptance of the requirements and expectations related to those activities.
  • You acknowledge and accept that the Platform's scope may evolve, and you agree to use it in accordance with any updated purposes communicated by us.
  • You understand that misuse or use beyond the intended scope may lead to restriction or termination of your access.
  • You consent to the monitoring of your activity to ensure compliance with the Platform's intended use and these Terms.
  • You acknowledge that your use of the Platform does not create any employment, agency, partnership, or joint venture relationship with Batchmates.
  • You agree to receive communications related to your use and the Platform's updates, which are part of your voluntary participation.
  • You understand and accept any risks associated with engaging in tasks or activities provided through the Platform.
  • You agree that your personal data will only be processed in ways consistent with the Platform's purpose and our Privacy Policy.

To access certain features of the Platform, you must register for an account. This section outlines the requirements and your responsibilities regarding account security:

Account Creation

To use the Platform, you must create an account with accurate and up-to-date information, including required verification documents such as a valid college ID and college code.

Eligibility Verification

Submission of false or misleading information during registration or use may lead to immediate suspension or termination of your account.

Account Credentials

You are responsible for safeguarding your username, password, and any other login credentials. Do not share these with anyone.

Unauthorized Access and Notification

You agree to notify us immediately if you become aware of any unauthorized access, security breach, or suspected theft involving your account information.

Account Activity Responsibility

You are fully responsible for all activities that occur under your account, whether authorized or unauthorized.

Account Suspension and Temporary Disablement

  • We reserve the right to temporarily disable or suspend your account without prior notice if suspicious or violating activity is detected.
  • Temporary suspension may also occur due to maintenance, policy updates, or legal compliance requirements.
  • During suspension, access to the Platform may be limited or blocked.

Account Deletion by User

  • You may delete your account at any time via the app's settings or by contacting our support.
  • Upon deletion, your access to the Platform and associated services will end immediately.
  • Some data may be retained after deletion as required for legal, security, or business purposes as outlined in our Privacy Policy.

Account Reactivation

  • If your account was temporarily disabled or suspended, you may request reactivation by following the Platform's reactivation process or contacting support.
  • Reactivation is subject to verification and approval by us.
  • Accounts deleted by the user generally cannot be restored.

Protection Against Account Information Theft

  • We implement reasonable security measures to protect your account information from unauthorized access or theft.
  • However, you acknowledge that no method of transmission or storage over the internet is 100% secure.
  • We are not liable for losses arising from account theft, unless caused by our gross negligence or willful misconduct.

Multiple Accounts Prohibition

Unless expressly authorized, you shall not create or operate multiple accounts.

Security Updates

We may enhance security features, including requiring stronger passwords or multi-factor authentication, to protect your account. Your continued use indicates acceptance of these changes.

Prohibited Activities

You agree not to engage in activities that compromise the security of the Platform or other users' accounts, including hacking, phishing, or distributing malware.

By using the Platform, you grant Batchmates specific rights and permissions that are essential to deliver, personalize, and improve the services offered to you. These include:

Personalized Experience

You authorize us to use your submitted data (e.g., activity, preferences, college ID, profile inputs) to customize the app interface, suggest relevant tasks or content, and prioritize experiences tailored to your interests.

Relevance and Smart Engagement

You grant us the right to analyze your activity to recommend updates, improve feature relevancy, reduce redundancy, and ensure your dashboard or task feed stays meaningful to your academic and social environment.

Communication and Notifications

You give us permission to communicate with you via SMS, in-app notifications, emails, or other appropriate channels for the purpose of providing service updates, activity reminders, alerts, and essential notices related to your account or the Platform.

Inviting Friends on Your Behalf

With your prior consent, you authorize us to access your shared contacts or institutional connections to invite eligible peers (such as classmates or verified college contacts) to the Platform on your behalf, solely for network-building and engagement purposes.

Feedback and Feature Usage

You permit us to observe anonymized usage patterns and incorporate any feedback or bug reports you provide to help improve the functionality and usability of the Platform.

SMS Access

You grant permission to send transactional and service-based SMS messages for registration, authentication, reminders, or feature engagement. We do not access or read your SMS content.

Photo & Media Uploads

When enabled, you allow the Platform to request access to your device's camera or gallery for uploading profile photos, task-related media, or community engagement features. This access is limited to the app interface only and not used beyond the Platform.

Location Access (If Applicable)

You may grant limited access to your device's location (approximate or precise) only if a specific feature—such as geo-tagged tasks, localized communities, or verification—requires it. Location access is always optional and user-controlled.

Device-Level Permissions

Depending on your operating system (iOS or Android), the Platform may request permission to access notifications, background activity (for real-time updates), or limited internet usage. All permissions can be managed through your device's settings.

Revoking Permissions

You have the right to revoke any of these permissions at any time via your device settings or within the app. Doing so may affect the availability or performance of certain features.

Data Protection Compliance

All usage of data and permissions granted are governed by our Privacy Policy, ensuring compliance with applicable data protection laws and ethical practices.

No Unauthorized Commercial Use

None of the rights or permissions you grant us allow the sale or external transfer of your data for advertising or unrelated third-party marketing purposes.

We collect certain categories of data from you directly, indirectly through your use of the Platform, and via permissions you grant during your interaction with the app. This section outlines in full detail what information we collect, how it's collected, and under what circumstances.

1. Information You Provide Directly

1.1 Account Registration Data

When We Request It

At the moment you register for an account and create your user profile within the app.

  • Full Legal Name: Used to identify you accurately within our system.

User Rights and Control
  • You may update your profile information except for verified mobile number and college code, which require re-verification to ensure ongoing compliance.
  • You have the right to request deletion of your account and personal data, after which all your data will be permanently erased, subject to legal retention obligations.
  • You may opt to temporarily disable your account, suspending data processing until reactivation.

1.2 Eligibility and Verification Data

When We Request It

During initial onboarding and periodically for compliance checks or re-verification requests.

Scope of Access
  • Photo or Scan of College ID: To verify student status.
  • Academic Year or Batch Details: To confirm eligibility and app access rights.
  • Institution Name and College Code: To match your profile with the educational institution.
Purpose of Collection
  • To ensure compliance with age (minimum 15 years) and student status requirements.
  • To restrict app access strictly to eligible users, maintaining platform integrity.
Data Storage and Security
  • Verification data is stored securely and access is highly restricted.
  • The data is used only for verification and never shared externally without explicit consent.
  • Retained only as long as necessary to confirm eligibility or comply with legal obligations.
User Rights and Control
  • You may request access to your verification data and request corrections if inaccurate.
  • You may withdraw consent for continued processing, but this may result in suspension or deletion of your account.

1.3 Profile Enrichment and Voluntary Information

When We Request It

When you voluntarily provide additional information to personalize your profile.

  • Profile photographs or avatars.
  • Optional personal details such as interests, bio, or contact preferences.
Purpose of Collection
  • To enable personalized content delivery and enhance community interactions.
  • To allow other users to identify and connect with you in a meaningful way.

  • Voluntary profile data is stored encrypted and protected by access controls.
  • Used exclusively within the app environment and never sold or used outside the platform.

1.4 Task Engagement Data

Continuously during your interaction with app features.

  • Records of task participation and completion.
  • Time spent on tasks, responses, uploads, or other user-generated content related to tasks.
Purpose of Collection
  • To measure engagement and participation for both user feedback and app improvement.
  • To tailor task recommendations based on your history and preferences.

  • Session data collection is fundamental for app security and operation and cannot be fully disabled without affecting service usability.
  • Any suspicious or unauthorized access identified from session logs triggers immediate security measures including notification to the user.

3. Information Collected via Permissions (User-Granted)

We access sensitive device features only after asking for permission, and only when necessary for specific features:

3.1 Limited Access to Gallery / Photo Library

We only request access to your device's gallery or photo library when necessary and with your explicit permission, for specific actions that enhance your experience or are essential for participation.

When We Request Access
  • To upload a profile picture for your account
  • To submit media (photos or screenshots) as part of a task, challenge, or verification process
  • When you choose to share something visually within a permitted activity or feature.
Scope of Access
  • Access is temporary and limited to the session in which you explicitly grant it.
  • We do not have continuous or background access to your gallery.
  • We cannot browse, scan, or index your device's storage.
  • You are in control of which file(s) to select and upload; the app cannot select files on your behalf.
Storage and Usage
  • Uploaded photos are securely transmitted to our servers.
  • Images are used only for the intended purpose (e.g., profile display, task validation).
  • All uploaded content is subject to the guidelines and terms described in your user agreement and may be removed if it violates our policies.
Revoking Permission
  • You can disable gallery access anytime through your device's permission settings.
  • If you revoke access, features requiring image upload may no longer function as intended.
  • We never access your camera roll, albums, or storage folders without consent. Your privacy is respected by design.

3.2 SMS Access Permissions

When We Request It

We request permission to access your SMS capabilities only when you use specific app features that require sending or receiving SMS messages, such as verification codes, two-factor authentication, or certain communication functions within the app.

Scope of Access
  • Ability to read incoming SMS messages containing verification codes (only if you consent).
  • Ability to send SMS messages on your behalf for app-related communication.
  • Access limited strictly to SMS features used by the app; no access to SMS unrelated to app functions.

  • SMS content is not stored permanently; verification codes are used only transiently for authentication purposes.
  • We do not read or store SMS messages unrelated to app verification or functions.

Your Control
  • You may choose not to grant SMS access permission; however, some features like automatic code verification may then require manual input.
  • You may revoke SMS permissions anytime via your device's app permissions settings.
  • We encourage reviewing app permissions regularly to maintain control over your data.

3.3 Location Access Permission

When We Request It

Location access is requested only for app functionalities that require geolocation data, such as task recommendations based on your location, location-based reminders, or social features involving nearby users.

  • Precise GPS coordinates (latitude and longitude).
  • Network-based location data derived from Wi-Fi or cellular towers.

3.4 Contact Access Permissions

Access to your contact list is requested only if you choose to use app features that involve inviting friends, sharing content, or connecting with people you know.

  • Reading contacts' names and phone numbers or email addresses.
  • Access limited strictly to facilitate in-app social functions or referrals.
  • No contact information is stored permanently without your explicit consent.

3.5 Push Notification Permissions

We request your permission to send push notifications to keep you informed about important app updates, task reminders, friend invitations, or other relevant communications.

  • Ability to send notifications to your device's notification center
  • Notifications may include alerts, badges, sounds, and message previews depending on your device settings
Why We Collect It
  • To notify you about app updates, new features, or scheduled tasks
  • To send reminders for pending or upcoming volunteer actions or responsibilities
  • To deliver important account-related alerts such as security notices or service interruptions
Storage and Usage
  • Notification preferences and tokens are stored securely and used solely to deliver messages
  • We do not share your notification tokens with third parties except service providers assisting in message delivery under strict confidentiality agreements
Your Control
  • You can enable or disable push notifications at any time via app settings or device notification preferences
  • You may customize the types of notifications you receive or mute them temporarily
  • Disabling notifications will not restrict app functionality but may limit timely updates and reminder

3.6 Inferred or Derived Data

When and How We Collect This Data

We infer your preferences based on your interactions within the app. For example, when you favorite certain tasks, spend more time on specific content, or engage with particular app features, we analyze this behavioral data to model your interests and preferences.

  • Interaction data such as task favorites, clicks, and time spent on various activities
  • Usage patterns that reveal your topic or task preferences
  • Implicit feedback derived from your engagement rather than explicit input

  • Facilitating repeat copyright violations.
  • Profiting from infringing content knowingly.

5. Defamation or Harassment

Not directly liable unless:

  • Defamatory content isn't removed after reports.
  • Algorithmically amplified content causes real-world harm.
  • Ignoring coordinated harassment or doxxing campaigns.

6. Algorithmic Harm / Addiction

Legal scrutiny around:

  • AI promoting harmful content for engagement.
  • Lack of transparency in content curation.

7. Discrimination or Bias

Liability for:

  • Bias in moderation or algorithmic content delivery.
  • Using biased AI systems without disclosure.

8. Non-Compliance with Local Laws

Risk of fines, bans, or legal actions if:

  • Non-compliance with country-specific laws.
  • Failure to cooperate with law enforcement.
  • Not appointing compliance officers as required (e.g., India's IT Rules).
  • We operate as an independent platform and are not affiliated, associated, endorsed, or partnered with any educational institution, coaching center, university, examination board, government body, or other third-party entity unless explicitly stated.
  • Any institution names, course titles, exam references, or syllabi mentioned on our platform are used solely for informational purposes and derived through publicly available APIs or data sources.
  • We do not use any official logos, emblems, trademarks, or proprietary visual identities of such institutions.
  • Our use of institution-related terminology is generic and does not imply any official relationship, approval, certification, or endorsement.
  • We do not conduct, promote, or facilitate any trade practices, commercial tie-ups, seat allocations, admissions, or financial arrangements with educational institutions.
  • Any academic or institutional data shown in the app is informational, universal, and publicly recognizable, intended to help users better navigate or compare offerings.
  • By using the App, you acknowledge that any resemblance or reference to educational brands or institutes is for contextual clarity only and does not indicate any real-world association.

Your access and use of the Services is subject to this TOS and all applicable laws and regulations. In addition You shall not:

Core Prohibitions

  • Access or use the Services if You are not fully able and legally competent to agree to this TOS, unless your Parents consent in terms of this TOS

  • Interfere with or attempt to interfere with the proper working of the Services, disrupt our website or any networks connected to the Services, or bypass any measures we may use to prevent or restrict access to the Services
  • Incorporate the Platform or any portion thereof into any other program or product. In such case, we reserve the right to refuse service, terminate accounts or limit access to the Services in our sole discretion
  • Use automated scripts to collect information from or otherwise interact with the Services
  • Impersonate any person or entity, or falsely state or otherwise misrepresent you or your affiliation with any person or entity, including giving the impression that any content you upload, post, transmit, distribute or otherwise make available emanates from the Services
  • Intimidate or harass another, or promote sexually explicit material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age
  • Use or attempt to use another's account, service or system without authorisation from Us, or create a false identity on the Services
  • Use the Services in a manner that may create a conflict of interest or undermine the purposes of the Services

Content Upload Restrictions

Use the Services to upload, transmit, distribute, store or otherwise make available in any way (including for the purposes of creating and/or streaming content):

  • Files that contain viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful
  • Any unsolicited or unauthorised advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other prohibited form of solicitation
  • Any private information of any third party, including addresses, phone numbers, email addresses, number and feature in the personal identity document (e.g., Aadhaar, License Number, Passport, Bank account) or credit card numbers
  • Any content which does or may infringe any copyright, trade mark or other intellectual property or privacy rights of any other person
  • Any content which is defamatory of any person, obscene, offensive, hateful or inflammatory
  • Any content that would constitute, encourage or provide instructions for a criminal offence, dangerous activities or self-harm
  • Any content that is deliberately designed to provoke or antagonise people, especially trolling, or is intended to harass, scare, distress, embarrass or upset people
  • Any content that contains a threat of any kind, including threats of physical violence
  • Any content that is racist or discriminatory, including discrimination on the basis of someone's race, religion, age, gender, disability or sexuality
  • Any answers, responses, comments, opinions, analysis or recommendations that you are not properly licensed or otherwise qualified to provide
  • Use any automated systems of software to withdraw data from the Platform
  • Content that, in our sole judgment, is objectionable or which restricts or inhibits any other person from using the Services, or which may expose Us, the Services or its users to any harm or liability of any type
  • Violate any law, regulation, contract, intellectual property or other third-party right, or commit a tort while using the Services
  • Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services in any manner
  • Use any robot, spider, crawler, scraper, or other automated means or interface not provided by Us to access the Services or to extract data
  • Encourage or induce any third party to engage in any of the activities prohibited under this Section

Warranties And Representations By You

You represent, warrant and acknowledge that:

  • You are authorised to access and use the Platform in terms of this TOS; in particular, the jurisdiction where You reside, hold citizenship in such jurisdiction as mentioned under this TOS that allows You to utilize the Services
  • If You are using the Platform on behalf of or for the benefit of any organisation then it is assumed that You have the right to do so. The organisation and You will be jointly and severally liable for Your actions including any breach of this TOS
  • Your use of the Services is at Your own risk. You agree that We shall not be liable for any damage or harm arising out of Your use of the Services. The use of our Services is entirely at your discretion. Interactions with known or unknown persons may have unintended consequences and we strongly urge you to seek adult supervision and advice while using our Services or features. You have the option to stop using our Services at any time.

Platform Discretion

We may, at Our sole discretion and without liability to You, with or without prior notice and at any time, modify, temporarily suspend or permanently terminate Your access to all or a portion of any Services, suspend Your User Account; and/or edit Your account details.

Content Removal

We can remove any content or information that you share on the Service if we believe that it violates this TOS, our policies or we are permitted or required to do so by law. We can refuse to provide or stop providing all or part of the Service to you (including terminating or disabling your access to our features) immediately to protect our community or services, or if you create risk or legal exposure for us, violate this TOS or our policies, if you infringe other people's intellectual property rights, or where we are permitted or required to do so by law.

Service Changes

We can also terminate or change the Service, remove or block content or information shared on our Service, or stop providing all or part of the Service at any time.

Content Persistence

Content you share with others on the Platform may continue to exist on the Platform even if you leave the Platform. We may backup, archive and retain your User Content even if you terminate or deactivate your account, or delete or remove specific User Content. The Platform and its users may retain and continue to use, store, display, reproduce, re-pin, modify, create derivative works, perform, and distribute any of your User Content that other users have stored or shared on the Platform.

Termination by User

You may also at Your sole discretion terminate Your Account by sending us a written request stating Your intentions to do so. Upon the receipt of Your request, We will provide You with a written notice of 30 (Thirty) days ("Notice Period") to permanently terminate Your Account.

No Liability

We will not be liable for any losses suffered by You resulting from any modification of any Services or from any suspension or termination of Your access to all or a portion of any Services.

Effect of Termination

In the event of discontinuation of all Services or other termination of Your right to access all Services: (a) We may delete or deactivate Your User Account and all related information and files in such account without liability to You; and (c). We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

THIS PLATFORM AND THE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" AND WE MAKE NO WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Warranty about Services

We provide no warranty about the Services. Without limiting the foregoing, We do not warrant that the Services will meet Your requirements or that it will be suitable for Your purposes.

User Responsibility

Unless required by law, we do not control what users may do or say, and we are not responsible for their (or your) actions or conduct (whether online or offline) or content (including unlawful or objectionable content).

Information Accuracy

The information provided on the Platform is for general information purposes only and is given in good faith. However, the information is selective, and We may not verify all information, which may not be complete or accurate for Your purposes and should not be relied upon without further enquiry.

You will defend, indemnify, and hold harmless the Company, its affiliates, and their respective shareholders, members, directors, officers, employees, attorneys, agents, representatives, suppliers and contractors (collectively, "Indemnified Parties") from any claim, demand, lawsuit, action, proceeding, investigation, liability, damage, loss, cost or expense, including without limitation reasonable attorneys' fees, arising out or relating to: Coverage Areas: 1. Remedial Actions

  • Send one or more formal warnings to You, if the breach can be remedied or corrected by You
  • Temporarily suspend Your access to Our Platform and suspend Your User Account
  • Permanently prohibit You from accessing Our Platform and Our Services
  • Block computers using Your IP address or contact any or all of Your internet service providers and request that they block Your access to Our Platform
  • Commence legal action against You, whether for contractual breach or otherwise
  • This TOS is governed by the laws of India.
  • Courts of Bangalore shall have exclusive jurisdiction over any disputes arising out of or in relation to this TOS.

Remedies

If You violate any of this TOS, We may, as We determine reasonably necessary to remedy or mitigate Your violation, delete all or part of such information transmitted by You, suspend or cancel Your User Account. We shall in no event be responsible or liable for any damage incurred by the user as a result of an action taken by Us pursuant to this paragraph.

Non-waiver

Our failure or delay in exercising any right, power, or privilege under this TOS shall not operate as a waiver thereof.

Severability

The invalidity or unenforceability of any of this TOS shall not affect the validity or enforceability of any other of this TOS, all of which shall remain in full force and effect.

Force Majeure

We will have no responsibility or liability for any failure or delay in performance of any Services, or any loss or damage that You may incur, due to any circumstance or event beyond Our control, including without limitation any flood, extraordinary weather conditions, earthquake, or other act of God, fire, war, insurrection, riot, labour dispute, accident, action of government, communications, power failure, or equipment or software malfunction.

Assignment

An Account cannot be sold or transferred. You are prohibited from buying or selling or exchanging accounts for cash or kind or any other value or for no value. You may not assign or transfer any right to use the Services or any of Your rights or obligations under this TOS without prior written consent from Us, including by operation of law.

Entire Agreement

This TOS contains the entire agreement and supersedes all prior and contemporaneous understandings between the parties regarding the Services on the Platform.
